In case you are selling food items, which require license under the Food Safety Act, 2006, you can only sell these items if they have license/registerred with FSSAI. Therefore please ensure that the said food items are duly licensed or registered, as required. Additonally, you are also required , as the case may be and depending on your turnover to obtain registration or license under the Act. The other important aspects to be kept in mind would include having a privacy policy, disclaimer and applicable terms and conditions allowing entry to the website, complying with the provisions of the Information Technology Act, 2002, in case of an incorporated Company, the provisions of the Companies Act, 2013, GST registration, having agreements in place with payment gateways etc.
The Food Safety and Standards Authority of India has also mandated that e-commerce food stores are requried to obtain Central License from the FSSAI before starting such a business and comply with all the provisions of the Food Safety Act, 2006 and the related Regulations.
The following aspects with respect to the entities whose products you are selling on the portal may also be checked and included in the respective agreements :
a. Entity must have Registration – In case the annual turnover does not exceed 12 lakhs per annum.
b. Entity must have License Central or State– In all other cases of turnover more than 12 lakhs per annum (Central in case the business operates in 2 or more states and under certain other conditions).
