I have plans to start a business with 3 of my friends, which would be SAAS product, which is by far a little similar to my current employers'. The employment contract that I had signed restricts me from performing any work directly or indirectly as an employer, employee, partner or advisor or freelancer or in any other capacity. and Any Intellectual property such as copyright, patent, trademarks etc with respect to any software products and solutions developed by me while employment. I have plans to resign from the currently employed firm in a couple of months, say in 1 year or so. Can we register this as a Pvt Ltd company or partnership based company while working under this agreement? Can my employer claim right on this startup? Is there any loophole to avoid this?
