There is no short-cut method of obtaining a Succession Certificate. You need to file a petition to the District Judge within whose jurisdiction the deceased person ordinarily resided at the time of his/her death or, if at that time he/she had no fixed place of residence, the District Judge within whose jurisdiction any part of the property of the deceased may be found. The petition must include:
- Time of death of the deceased;
- Residence or details of properties of the deceased at the time of death within which the jurisdiction falls under;
- Details of family or other near relatives;
- The rights of the petitioner;
- The absence of any impediment to the grant of a certificate.
Also, a copy of the death certificate is required to be produced. Afterwards, the Court will issue a notice in the newspapers for a given period, generally 45 days. In the case where no one contests the petition on or before the expiry of given period, the court grants the order for issuance of succession certificate.
Court Fee Waiver: No, merely because you are a woman will not entitle you to any remission, exemption or waiver of the Court fee. It is allowed only in cases of property disputes, divorce cases, violence cases and maintenance cases.
