It is clear that your friend is trying to cheat you and if this continues, you will have to take legal action against him for recovery of your money. However, before proceeding with the legal case, send him a legal notice clearly stating that he owes you money which has not been paid back, even after repeated reminders. Collect all the evidence you have for the same and mention it in the notice. Provide him with a due date to repay the amount he owes to you. If he replies by stating that the money has been repaid, ask him to provide proof of the same. If no reply is given and no repayment is made, you will have to initiate legal proceedings against him. You have no other choice. You will need to file a civil recovery suit in the concerned district court. You can try to negotiate and settle with him out-of-court, but he must be willing to do so in the first place.
Proceeding with a summary suit will be in your best interest. Compared to normal suits, summary suits are disposed of faster. Once the suit is instituted and the summons is issued, the defendant has 10 days to make an appearance, failing which the court assumes the plaintiff 's allegations to be true and, accordingly, awards the plaintiff. If the defendant makes an appearance, the court accepts his defense only if it is convinced that it is substantial to the case in question.
