The legal formalities required for the start of business are as follows:
- The form of incorporation of the business is required to be considered, i.e. whether the business is required to be run as a Sole Proprietorship, Company incorporated under the Companies Act, 2013, a Partnership firm either the Partnership Act, 1932 or the Limited Liability Partnership Act, 2008.
- The necessary agreements with the labor/worker/employees if any to be employed, with vendors for supply of raw material, with customers to whom supply/services are to be made would also be required be executed.
- In case applicable, registration under the GST regime would also be required to be obtained.
- The various business specific licenses, for example under the Food Safety and Standards Act, 2006, etc. would be required to be obtained.
- The labor licenses, in case applicable, would be required to be obtained.
- A PAN Card would be required to be obtained in the name of the said entity carrying out business A bank account is required to be obtained in the name of the said entity after completing the Know Your Customer norms of the bank.
- The capital of the business, i.e. equity and debt etc. is also required to be decided for the business.
